§ 8.1. Municipal Court.

    There shall be a Municipal Court which shall have jurisdiction to hear and determine all cases arising under this Charter or the ordinances of the Town. The powers of and the procedure in the Municipal Court and the manner of enforcement of its orders and judgments shall be as provided for under the statutes of the State of Colorado and the Colorado Municipal Court Rules of Procedure as now in effect or as hereafter adopted, unless superseded by ordinance presently enacted or hereafter enacted. The Municipal Court shall be a qualified Municipal Court of record and all proceedings therein and evidence at trials shall be kept by verbatim record by either an electronic or stenographic means.

    b.

    The Council shall provide a suitable place and all supplies and personnel necessary for the proper functioning of the Court.

    c.

    The Council shall provide for the enforcement of its ordinances by fine, imprisonment, public service or any combination of the three (3).

    d.

    The Council may provide by ordinance for the enforcement of its ordinances by fine or public service or both for persons under the age of eighteen (18) years and over the age of ten (10) years. In no event shall any ordinance or Municipal Court sentence pertaining to persons over ten (10) years of age but under eighteen (18) years of age include the possibility of imprisonment.
