§ 12.2. Creation of Improvement Districts.

Improvement districts created pursuant to this Charter may be created by:
a.

Ordinance, subject however to protest by the owners of a majority of all property benefited and constituting a basis of assessment, as the Council may determine; or

b.

By the owners of not less than fifty percent (50%) of the area to be assessed in the proposed district, provided that such majority shall include not less than fifty percent (50%) of the assessed valuation of the real property in the proposed district.
