Chapter 6.06. Open Fire and Open Burning Restrictions |
§ 6.06.070. Stage 1 exceptions.
Except where the Emergency Manager has elevated fire and burning restrictions to Stage 2 (enacted in cases of most extreme fire danger), the following shall be excepted from Section 6.06.060 above during Stage 1 restrictions:
(1)
Permitted fires. Fires for which a permit has been obtained from the South Metro Fire Rescue Authority.
(2)
Gas- and liquid-fuel-powered appliances. Fires contained within liquid-fueled or gas-fueled stoves, grills, fire pits or other gas- or liquid-fueled appliances.
(3)
Fireplaces, wood-burning stoves. Fires contained within fireplaces and wood-burning stoves within buildings only.
(4)
Explosive waste. Burning of explosive wastes by the manufacturer of explosives in areas zoned for industrial use, when the burning is supervised by the South Metro Fire Rescue Authority.
(5)
Suppression fires. Open fires or open burning by any federal, state or local officer, or member of the South Metro Fire Rescue Authority in the performance of an official duty.
(6)
Professional fireworks displays. If permitted by the Emergency Manager, following consultation with the South Metro Fire Rescue Authority, subject to C.R.S. § 24-33.5-2003, and any mitigation measures required by the Emergency Manager.
(7)
Small recreational fires. At developed picnic sites contained in a fixed permanent metal/steel fire pit (rock fire rings are considered temporary and not permanent) with flame lengths not in excess of four (4) feet, or the residential use of charcoal grills, tiki torches, fires in chimineas or other portable fireplaces or patio fire pits, so long as said fires are supervised by a responsible party at least eighteen (18) years of age. These recreational fires shall burn materials other than rubbish and shall have a total fuel area of three (3) feet (914 mm) or less in diameter and two (2) feet (610 mm) or less in height for pleasure, religious, ceremonial, cooking, warmth or similar purposes, and shall in no event be construed to include fireworks as defined in Section 6.06.050 above.
