Chapter 13.16. Preliminary Site Plan Standards and Procedures |
§ 13.16.040. General requirements.
(a)
Preliminary site plan approval shall not mean that the project has received final approval under Chapter 13.06 of this Title. Preliminary site plan approval shall only indicate the proposed project is in general compliance with the requirements of the Parker Land Development Ordinance, design criteria, and other regulatory requirements. A final site plan in terms of exact arrangement of buildings, building architecture, parking areas, open spaces, access points, infrastructure/utilities and all final site design features and improvements shall be required under Chapter 13.06 of this Title.
(b)
No building permit for any use described in Subsection (a) above shall be issued for the construction of any new building, structure, or improvement to the site or any addition or alteration to any structure on the site or site itself, including exterior materials or colors, without first obtaining the approval of a final site plan under Chapter 13.06 of this Title for the proposed use.
(c)
No overlot grading, excavation, drainage work, parking lot construction or other site improvements will be allowed, without first obtaining approval of a final site plan under Chapter 13.06 of this Title for the proposed use or structure. This Section shall not apply to demolition permits.
(d)
The general requirements outlined by this Section apply to the zone districts and uses outlined in Subsection 13.16.030(a) above. These general requirements are in addition to any other development or design standard which may otherwise be applicable to a particular site or specific area within the Town. In the case of any perceived conflict among applicable development standards, the more restrictive standard will apply.
(e)
The preliminary site plan is in general compliance with the Town of Parker Architectural and Design Standards for Commercial, Industrial and Multiple-Family Projects.
(f)
The approval of a preliminary site plan is not affected by change of tenancy, ownership, or management of a site, with the exception of the following:
(1)
Substantial change to building layout or use of the site prior to final site plan approval under Chapter 13.06 of this Title, as determined by the Town.
(2)
Amendments to the Town's Storm Drainage and Environmental Criteria Manual, the Town of Parker Architectural and Design Standards for Commercial, Industrial and Multiple-Family Projects, or any other applicable standard adopted or amended by the Town that results in the preliminary site plan being out of compliance with these standards.
(g)
In approving a preliminary site plan, the Planning Director and Engineering/Public Works Director may impose conditions, stipulations, or limitations as deemed necessary to ensure compliance with Parker Land Development Ordinance, design standards or other regulatory requirements with the submission of a final site plan under Chapter 13.06 of this Title. All future development of the site shall be subject to the preliminary site plan and shall comply with such conditions, stipulations, or limitations.
